Do You Own Your Website? Five Questions Before You Sign

Who owns the domain, the design and the content? Five questions to ask before you sign, and the answers that mean walk away.

A website is an asset, or it is a rental. The difference is decided before you pay, in a contract and in who holds the logins. Five questions settle it.

1. Who owns the domain, and whose account is it in?

The domain is your address, and it is the one piece that cannot be substituted. It should be registered in your name, in an account you can sign into, with your email on it. If the designer holds it, ask them to transfer it now, not in three years when you want to move on.

2. Who owns the design, the code and the words?

Ask plainly: "If we stop working together, do I keep the site?" The right answer is yes, and it is worth having in writing. The wrong answer includes the phrase "licensed to you", which usually means rented.

3. If I leave, what comes with me, and in what form?

Ask for the format: the files, the images, the text, the database if there is one. A site you can export is worth more than a site you can only look at.

4. What happens to the pages if I stop paying?

Subscription builders look cheap because the site is not yours; stop paying and it disappears. That is a fair deal if you know it going in, and an expensive surprise if you do not. Ask the question out loud.

5. Can I see and export my own data?

Leads, form submissions, customers, orders. If the answer is no, you do not own the part of the business that matters most, whatever the contract says about the design.

The answers that should make you pause

  • The domain is registered by the vendor "on your behalf".
  • "We host it, so it can't be moved."
  • The site lives in a builder where leaving means starting again.
  • A long contract with no exit, for a site that should be a one-time purchase.
  • Data you can ask to see but never receive.
